Lyfebulb, a Patient Care America business, (“Lyfebulb” or “we,” “our” or “us”) has prepared this Privacy Policy (“Policy”) to describe our practices regarding the personal information that we collect, use, and share through TransplantLyfe365 (“App”). Capitalized terms not defined in this Policy have the meanings in our End User License Agreement. This Policy is part of the End User License Agreement and governs your use of TransplantLyfe365.

By using TransplantLyfe365, you consent to our collection, use, and disclosure of information that individually identifies you (“Personal Information”) in the manner we describe in this Policy. If you do not agree to be bound by this Policy, you may not access or use TransplantLyfe365.

Some of the information that you provide through TransplantLyfe365 may be considered “sensitive information” under certain data privacy laws. Unless you provide us with separate consent, we will not use your sensitive information other than in connection with providing TransplantLyfe365 as described in this Policy. For our users located outside of the United States of America, all information collected through TransplantLyfe365 will be stored in the United States of America. If you are contacting us from outside of the United States, we are notifying you that your information might not receive the same level of protection and safeguards as provided in your own country and that your information may be subject to lawful requests and access by the courts and law enforcement authorities in the United States without your knowledge or consent. By using TransplantLyfe365, you consent to your information being processed under the laws of the United States. If you do not consent to the storage of your Personal Information in the United States, and that your information is subject to the laws of the United States, do not provide us with any of your Personal Information.

TransplantLyfe365 is not intended to be used by anyone under the age of 18 regardless of parental or guardian consent. If you are younger than 18, you are not authorized to use TransplantLyfe365.

Information We Collect

We collect the information that you provide to us to register for an account to use TransplantLyfe365 (“Account”). We also collect and store the information that you choose to enter into TransplantLyfe365 to take advantage of its functions and services. This information might contain your personal information such as address and phone number, information of other individuals who are important to your health care such as relatives, friends, and medical professionals, and information directly relating to your health and well-being such as lists of medications, daily routines, diet, and medical appointments. We recognize that your health related information is sensitive information and very important to you. We explain our commitment to its security below.

We may need to place cookies on your device to collect usage information. Your device may enable you to block cookies, which you are entitled to do. However, you may lose some functionality if you block all cookies.

We also collect usage information automatically when you register with TransplantLyfe365 and each time you use or access the App (“Usage Data”). This Usage Data may include a user ID that we assign to your device, your device’s Internet Protocol (“IP”) address, device name, operating system version, configuration of the App when in use, the time and date of your use, and other statistics.   • For research and analysis, where we monitor and draw conclusions from the information entered into TransplantLyfe365 by our users to help us derive tools, routines, insights, and trends that improve our users’ wellbeing.

Sharing of Personal Information

We may share your Personal Information:

  • With our service providers, such as data hosting services, email management services, and data analysis consultants.
  • With companies that are affiliated with us (that is, that control, are controlled by, or are under common control with us).
  • If we sell all or part of our business or make a sale or transfer of assets or are otherwise involved in a merger or business transfer, we may transfer your Personal Information to a third party as part of that transaction.

We shall request your consent for any other sharing of your Personal Information. TransplantLyfe365 data may be valuable to healthcare providers in assessing tools and procedures provided or recommended to transplant patients. Subject to the Privacy Policy – HIPAA and Patient Rights policies, and to the extent allowed by law, we may share your information with healthcare providers for such purposes. We may also publish studies based upon your information so long as no individual is identifiable in or from such publication. We will procure your separate written consent for any use or study if additional consent is required by law.

We may use third-party web analytics services, such as those of Google Analytics 4 or Apple’s App Analytics services. These analytics services use cookies and other similar technologies to help us analyze use of the App. The information collected by such technologies will be disclosed to or collected directly by these services, who use the information to evaluate your use of the App. Some state laws may deem our sharing of your Personal Information with these analytics services to be a “sale” or “sharing” of your Personal Information. You may be able to control such sharing through your device settings or through your privacy settings with Apple or Google.

While we use reasonable efforts to protect your Personal Information from the risks presented by unauthorized access or acquisition, no method of transmission of information or method of electronic storage is fully secure. We cannot guarantee the security of your Personal Information. If we have a confirmed unauthorized access to your Personal Information, we will comply with all applicable laws to contact you, which may be through the App or through any other form of contact that you have provided to us.

Children’s Privacy

We do not intend TransplantLyfe365 to be used by children. TransplantLyfe365 is not intended for anyone under the age of 18. In compliance with the Children’s Online Privacy Protection Act, we do not knowingly collect Personal Information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided Personal Information through TransplantLyfe365, please contact us. If we become aware that we have collected Personal Information from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.

Links within TransplantLyfe365

TransplantLyfe365 may contain links to websites and services that are not operated by us. If you click on a third party link within the App, you will be directed to that third party’s site or services. We strongly advise you to review the Privacy Policy of every site or service that you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Your Data Rights

Certain states, provinces, and countries require us to notify you and provide you with certain rights relating to your Personal Information.

If you reside in California, Colorado, Connecticut, Oregon, Texas, Montana, Utah, or Virginia; or reside in Quebec, Canada; or are located in the European Economic Area or in the United Kingdom, you have the following rights relating to our collection and use of your Personal Information:

  • The right to correct inaccuracies.
  • The right to require us to delete your Personal Information, subject to the exclusions described below.

If you request that we delete your Personal Information, we will comply; however, you should note that we are entitled to keep your Personal Information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our business purposes.

If you request your data to be deleted, we will completely anonymize your data in order to retain the valuable information you have provided. If information cannot be made anonymous, we will redact or delete the information.

Typically, we will not charge a fee to comply with your request. We may require additional information from you to confirm your identity or that the agent acting on your behalf is properly authorized. We do not discriminate against anyone for exercising their legal rights.

Colorado, Connecticut, Oregon, Texas, Montana, Virginia Residents: You have the right to appeal if we reject your data rights request. If your data rights request is rejected, we will contact you with instructions on how to pursue an appeal.

Information not Subject to This Policy

We may retain and use fully de-identified and aggregated information indefinitely. De-identified and aggregated information is not included as Personal Information and is not subject to this Policy.

Information about you that is available through a public or governmental source is not included as Personal Information and is not subject to this Policy.
